Abstract

According to Article 1 of Council Directive 94/95 (O.J. L 254/64, Septembre 9 1994), Communityscale groups of undertakings shall establish a European Works Council or a procedure for informing and consulting employees. Such obligation also applies to groups having their seat in Switzerland. A European Works Council may be established at Swiss headquarters, the easiest method being to be able to show that «there is already an agreement» which existed prior to the Directive entering into force.
